This is the Last Will and Testament of me Richard MASON of Soulby in the parish of Kirkby Stephen in the County of Westmorland Yeoman. I give and devise all that my cottage house situate on the West Side of the Street in the Town of Kirkby Stephen, aforesaid and now in the occupation of Richard GUG, as tenant thereof unto my Son James MASON for and during the term of his natural life and from and after his decease I give and devise the same unto my daughter Ann BALMER her heirs and assigns for ever And as to all that my other Cottage House adjoining the above named Cottage House and Situate at the North End thereof and now in the occupation of Edward METCALFE as tenant thereof I give and devise the same unto my said Daughter Ann BALMER for and during the term of her natural life and from and after her decease I give and devise the same to the heirs and assigns of the said Ann BALMER for ever As to all that my Cottage House Garden and premises now in the occupation of Mary ATKINSON and situate on the East Side of the Main Street in Kirkby Stephen aforesaid I give and devise the same unto my daughter Eleanor FAWCETT for and during the term of her natural life and from and after her decease I give and devise the same unto and equally between and amongst all and every the child and children of the said Eleanor FAWCETT their heirs and assigns for ever as tenants in Common and not as Joint tenants As to the Cottage House, and outbuildings adjoining thereto and Garth behind the same situate at Soulby aforesaid and now in my own occupation and also all my household Goods furniture and Effects in my said Dwellinghouse at the time of my decease (except money, and securities for money Title Deeds and Documents) I give, devise and bequeath the same unto my Son Thomas MASON for and during the term of his natural life and from and after his decease I give devise and bequeath the Same unto and equally between and amongst all and every the child and children of the said Thomas MASON their heirs and assigns for ever as tenants in Common and not as Joint tenants. As to all those my two Cottage houses situate at Soulby aforesaid (and adjoining to the premises lastly devised to my Son Thomas MASON) I give and devise the same unto my daughter Deborah RICHARDSON for and during the term of her natural life and from and after her decease I give and devise the same unto and equally between and amongst all and every the child and children of my Daughter Deborah RICHARDSON their heirs and assigns forever as tenants in Common and not as joint tenants As to all that my Cottage House and Garden situate at Hartley in the parish of Kirkby Stephen aforesaid now standing empty but recently occupied by John LONGSTAFF I give and devise the same to my Son Henry MASON for and during the term of his natural life and from and after his decease I give and devise the same to my Son William MASON his heirs and assigns for ever And as to all that my other Cottage House situate in Hartley, aforesaid and adjoining the last named Dwelling house and partly occupied by Betty TINKLER I give and devise the same unto my son William MASON for and during the term of his natural life and from and after his decease I give and devise the same to the heirs and assigns of the aid William MASON for ever And as to all the rest residue and remainder of my real Estate whatsoever and wheresoever situate to which I shall be entitled at the time of my decease (and not hereinbefore disposed of) I give and bequeath the same unto my Son in Law Richard FAWCETT and my Son Thomas MASON their heirs Executors administrators and assigns respectively Upon Trust as to my real Estate to let the same from year to year or for any term not exceeding seven years in possession at the best rent and subject to such covenants and conditions as my said Trustees shall think reasonable and generally to manage the same in such manner as my said trustees shall in their discretion think most beneficial for my paid Estate and to stand possessed of the annual rents thereof unto the Trusts hereinafter mentioned and declared concerning the same And upon Trust as to the residue of my personal Estate to convert collect and get in the same and to dispose of the moneys to arise thereupon in manner hereinafter directed and declared concerning the same that is to say as to the rents and annual Income of my real Estate and as to the dividends and annual produce arising from my residuary personal Estate Upon Trust in the first place to bear pay and discharge all my just debts funeral and testamentary expenses and the expenses of proving this my Will and from and after payment thereof and subject thereto Upon Trust that they my said Trustees shall and do in the next place provide each of my children (living at the time of my decease) namely James MASON, Henry MASON, William MASON, Ann BALMER, Eleanor FAWCETT, Thomas MASON and Deborah RICHARDSON with such mourning as my said Trustees and Executors shall in their discretion think reasonable and from and after payment thereof and subject thereto Upon Trust to invest the residue of the money arising from the Sale, conversion and getting in of the residue of my said personal Estate in their names in or upon the public Stocks or other government securities or any real securities in the United Kingdom with power to vary the investment from time to time for any other of the like nature and then upon further trust as to the rents of my said real Estate and as to the annual produce of my said trust fund thenceforth to become due In Trust to pay the same unto and equally between all and every my Sons and Daughters hereinbefore named for and during the respective terms of there respective natural lives and from and after the decease of any one or more of my said children Upon Trust to pay the share (of and in the rents and profits arising from my said real and personal Estate as aforesaid) of any child or children of mine so dying unto and equally between all and every the child and children of such deceased child or children who shall die leaving lawful issue but if any child or children of mine shall die without leaving lawful issue then Upon Trust for the survivors or survivor of my said children hereinbefore named equally and from and after the death of my last surviving child Then upon Trust for all and every the child and children of all my said Sons and Daughters hereinbefore named who shall die leaving lawful issue either before or after my decease or the issue of any such child or children of any of my said Sons and Daughters as shall predecease them or any or either or them as shall if a Son attain the age of twenty one years or if a daughter attain that age or marry the said fund to be divided equally between the issue of deceased Sons and Daughters but so that the children of a deceased Son or daughter shall only take the share to which their parent would have been entitled to if living. I declare that the receipts of my said Trustees for any money paid to them in that character shall exonerate the persons paying the same from all liability in respect of the application thereof I declare that the power of Sale, provisions as to investment of trusts funds, maintenance, appointments of and powers of trustees and Executors contained in Sections 1,2,3,25,26,17,28,29 and 30 of an Act passed in the 23rd and 24th years of the reign of Her present Majesty Queen Victoria entitled 'An Act to give Trustees Mortgagees and others certain powers now commonly inserted in Settlements Mortgages and Wills' shall operate and take effect as if the same had been fully and at length invoked herein I devise all the real Estate vested in me as Trustee or Mortgagee to my said Trustees their heirs and assigns subject to the Trusts and Equities affecting the same respectively I appoint my said Son in Law Richard FAWCETT and my said Son Thomas MASON joint Executors of this my Will And lastly I revoke all former and other Wills declaring this writing alone to express the whole of my Will In witness whereof I have signed my name at the foot or End of this my Will contained in this and the two proceeding sheets of paper this eleventh day of October in the year of our Lord One thousand eight hundred and sixty four

This is a Codicil to the last will and Testament of me Richard MASON of Soulby in the County of Westmorland Yeoman which Will bears date the thirteenth day of October in the year of our Lord one thousand eight hundred and sixty four Whereas by my said Will I devise a Cottage House with the appurtenances situate in Kirkby Stephen in the said County to my Son James MASON with remainder over to my daughter Ann BALMER and her children lawfully begotten forever And whereas my said Son James MASON hath since departed this life by means whereof the devise over to my said daughter Ann BALMER and her children will take effect immediately after my decease And whereas by my said Will I have devised two Cottage Houses with appurtenances situate at Soulby aforesaid unto my daughter Deborah RICHARDSON Wife of Thomas RICHARDSON of Soulby aforesaid for her life and from and after her decease unto and equally between and amongst all and every her children share and share alike And I have also by my said Will devised and bequeathed unto my said daughter Deborah RICHARDSON one sixth part or share of my residuary real and personal Estate now I do hereby revoke my said Will so far as my daughter Deborah RICHARDSON and her children are objects thereof And whereas my Said Son in Law Thomas RICHARDSON is now indebted to me in the sum of Thirty Pounds Now I do hereby give and bequeath unto my said Daughter Deborah RICHARDSON Wife of the said Thomas RICHARDSON the sum of thirty pounds as due and owing to me as aforesaid And all interest which shall be due to me thereon at the time of my decease for her own absolute use and benefit I devise my two Cottage Houses situate at Soulby aforesaid one occupied by William HODGSON and the other empty to my said Son Thomas MASON his heirs and assigns for ever in addition to the Cottage house and premises devised to him by my said Will And whereas by my said Will I have given devised and bequeathed All the rest residue and remainder of my real and personal Estate and Effects whatsoever and wheresoever unto my Trustees and Executors Richard FAWCETT and Thomas MASON upon certain trusts therein named Now I do hereby revoke the said devise and bequest of my residuary real and personal Estate And I give and devise and bequeath the same unto my Son in Law Richard FAWCETT and my Son Thomas MASON upon trust as soon as may be after my decease to sell and convert the same with full power to convey the same to any purchaser or purchasers and to give receipts, acquittances and discharges for the purchase monies but subject to the payment of all my just debts funeral and testamentary expenses and the expenses of proving and establishing this my will and also of all expenses attending such Sale and conversion as aforesaid and from and from and after payment thereof and subject thereto I give and bequeath the same unto and equally between and amongst my children Thomas MASON, Henry MASON, William MASON, Eleanor FAWCETT and Ann BALMER for their own absolute use and benefit.
But I confirm my said Will in all other respects. In witness whereof I the said Richard MASON the testator have signed my name at the foot or end of this my codicil this twenty fourth day of August in the year of our Lord One thousand eight hundred and sixty eight

Proved at Carlisle with one Codicil the second day of October 1868 by the oaths of Richard FAWCETT and Thomas MASON, Son of the Testator, the Executors named in the Will to whom administration was granted.
The Testator Richard MASON was late of Soulby in the parish of Kirkby Stephen in the County of Westmorland Yeoman and died on the twenty ninth day of August 1868 at Soulby aforesaid.

On the second day of October 1868 the Will with one codicil thereto of Richard MASON late of Soulby in the Parish of Kirkby Stephen in the County of Westmorland Yeoman decease, who died on the twenty ninth day of August 1868 at Soulby aforesaid was proved in the District Registry attached to Her Majesty's Court of Probate at Carlisle by the Oaths of Richard FAWCETT of Kirkby Stephen aforesaid in the County of Westmorland Tallow Chandler and Thomas MASON of Black Boy near Bishop Auckland in the County of Durham Labourer, son of the deceased, the executors named in the said will They have been first sworn duly to administer.
